 § 1 Scope and provider

 (1) These general terms and conditions apply to all contracts concluded with us as a provider in the online shop

(2) Customers within the meaning of the terms and conditions are both consumers and entrepreneurs. Some restrictions apply to entrepreneurs, which are each marked separately. 

Entrepreneurs within the meaning of the terms and conditions are natural or legal persons or partnerships with legal capacity, with whom a business relationship is entered into and who act in the exercise of a commercial or self-employed professional activity.

The range of goods in our online shop is aimed exclusively at buyers who have reached the age of 18.

 § 2 Offer and conclusion of contract

(1) The seller's offers are subject to change and non-binding, unless the seller has expressly designated them as binding in writing.

(2) Deviations from the illustrations and descriptions are possible, since the color always changes slightly due to the display on the screen.

(3) The acceptance of the offer (and thus the conclusion of the contract) takes place immediately after the order by confirmation in text form (e.g. e-mail), in which the execution of the order or delivery of the goods is confirmed to you (order confirmation).

If you have not received a corresponding message, you are no longer bound to your order. Any services already provided will be reimbursed immediately in this case.

(4) The processing of the order and the transmission of all information required in connection with the conclusion of the contract takes place via e-mail, in some cases automatically. You must therefore ensure that the e-mail address you have given us is correct, that the receipt of the e-mails is technically guaranteed and, in particular, that it is not prevented by SPAM filters.


 § 3 Prices and terms of payment

(1) The seller's prices stated on the product page include the statutory value-added tax (19%). The shipping costs are added separately. 

In the context of invoicing, the value added tax is shown separately.

(2) The shipping costs only apply once, no matter how many items are purchased. 

You have the option of shipping within Germany
to choose between DPD and DHL.
For small consignments up to 500 g and a maximum height of 2 cm
We ship with Deutsche Post (only in Germany).

And for other countries, we send parcels up to 1 kg internationally with DHL Warenpost and larger packages with DHL Paket international.
For shipping to the EU. Zone 1 over 1 kg we ship with DPD.

§ 4 Delivery; retention of title

(1) Unless otherwise agreed, the goods will be delivered from our warehouse to the address you provide.

(2) The goods remain our property until the purchase price has been paid in full.

(3) The goods will only be shipped after the purchase price has been credited to the seller's account. 

 

§ 5 Liability

Nijens has unlimited liability for damage caused by an intentional or grossly negligent breach of duty by Nijens or a vicarious agent of Nijens based.

In the event of a breach of a material obligation Nijens or a vicarious agent Nijens liable Nijens even in the case of slight negligence. An obligation is essential if its violation jeopardizes the achievement of the purpose of the contract or if its fulfillment makes the proper execution of the contract possible in the first place and on compliance with which the contractual partner regularly relies and may rely. Liable in the case of a slightly negligent violation of such an essential obligation Nijens only for the foreseeable, contract-typical damage.

The limitations of liability formulated above do not apply to damage resulting from injury to life, limb or health or in the case of a fraudulently concealed defect.

Liability under the Product Liability Act is not affected by this.

 

 § 6 Final Provision / Applicable Law

(1) Restriction towards entrepreneurs: The place of performance and place of jurisdiction for deliveries and payments as well as all disputes arising between the seller and the customer from the purchase contracts concluded between the parties is the seller's registered office. The place of jurisdiction is the company headquarters.

2) Should one or more provisions of these Terms and Conditions be or become ineffective, this does not affect the effectiveness of the other provisions.
